Conditions and Terms of Use

Alcalá de Guadaíra's Town Council (hereinafter the Town Council), puts at the disposal of all the citizens, visitors and companies of the Alcalá de Guadaíra municipality the website turismoalcaladeguadaira.es, in the terms described in the following Conditions:

First.- Definition of Users

Access and/or use of turismoalcaladeguadaira.es grants anyone the condition of user, understanding that the user accepts from that moment on and with no reservations the present General Conditions, without prejudice of the Particular Conditions the Town Council could establish for registered users, or for the regulation of certain services and/or contents.

In case the user were under age she/he will have to obtain previous permission from her/his parents, guardians or legal representatives, who will be considered responsible for any purpose of all the acts carried out by the minors under their care.

Second.- Users' Obligations

By using turismoalcaladeguadaira.es you agree to use it only for lawful purposes, according regulations in force, good faith, public order and the generally accepted habits and customs.

Also, the user agrees not to use turismoalcaladeguadaira.es in a way that may be illicit or harmful to the rights and/or interests of the Town Council and/or third parties, and also not to cause damages or prevent the normal working of turismoalcaladeguadaira.es.

Third.- Users' Liability

The users' will be held as only and exclusive responsible for the use of turismoalcaladeguadaira.es, holding in any case the Town Council harmless before any direct or indirect damages, caused by the non-compliance with the present General Conditions by the users to the same users or to third parties.

Regarding this, the Town Council reserves the right to deny access to and/or use of turismoalcaladeguadaira.es or of any of its contents and/or services, to any user that would have not fulfilled the present General Conditions or that may have made an unlawful use of this website, being able to exert all civil and penal actions that may concern the Town Council by Law.

Four.- Town Council Liability

The Town Council provides the services the present conditions are related to for free; notwithstanding this, it will be able to set rates for certain offered services or products, informing in an opportune time in the sections aimed for them.

The Town Council will not hold responsible for damages of any nature that could be suffered by users or third parties that may arise from:

• The lack of availability, maintenance or effective working of turismoalcaladeguadaira.es, of its services or contents;

• the lack of usefulness, veracity, uitableness or validity of turismoalcaladeguadaira.es, its services or contents to fulfill the users' needs or expectatives;

• the use by a third party of turismoalcaladeguadaira.es, infringing the safety measures established by the Town Council, of its contents or services for viruses' remission, or the agreement of this third party to carry out a non authorized treatment of the data stored by the Town Council;

• in general, any use of turismoalcaladeguadaira.es, its services and/or contents that may be made but any user or a third party, against the Conditions of access and use of them approved by the Town Council.

Five.- Intellectual and Industrial Property

Contents at the disposal of users displayed by the Town Council are protected by the required intellectual property rights and they have been legally assigned by the corresponding holders for the appropriate purposes.

The Town Council authorizes the use of the contents of turismoalcaladeguadaira.es for the intentions specifically planned in it or in the present General Conditions, being prohibited any type of reproduction, distribution, modification or public communication of the same either totally or in part, except under express authorization and or in cases authorized by Law.

The Town Council itself or as asignee, holds all the intellectual and industrial property rights of this website, as well as of the elements contained in it (e.g., pictures, sound, audio, video, software or texts; hallmarks or logos, colour combinations, structure and design, selection of used materials, computer programs necessary for its working, access and use, etc...), being specifically prohibited the use or reproduction of them beyond what the present Conditions specifically anticipate.

Users commit themselves to respect all intellectual and industrial property rights of the aforementioned website. They will be able to see the elements of the website and even to print them, copy and store them in their computers' hard drive or in any other physical support only and exclusively, for their personal and private use, being, therefore, definitively forbidden the transformation, distribution, public communication, put at others' disposal or any another kind of exploitation, as well as its modification, alteration or descompilation. Users will refrain themselves from suppressing, changing, avoiding or manipulating any protective device or security system installed in the portal turismoalcaladeguadaira.es.

Six.- Links

Links put at the users' disposal by the Town Council have like only purpose to make access to other contents and/or services that may be of someone's interest easier, but they are neither managed nor controlled by the Town Council.

The Town Council does not hold directly or indirectly responsibility regarding legallity, veracity, usefulness, quality or reliability of the contents and/or services not directly managed or controlled by the Town Council, although these were accessible through turismoalcaladeguadaira.es. In the same way, including these external links does not involve any kind of association, merging or participation of the Town Council with the linked entities.

Seven.- Personal Data Processing

The Town Council has a Privacy Policy in order to regulate the collection, storage, treatment and use of the personal information the users provide the Town Council with; there is also a list of General Conditions of Use for Registered Members at turismoalcaladeguadaira.es. Regarding this, the Town Council commits itself to fulfill such Policy and General Conditions, which can be looked up by users by clicking on the link to Privacy Policy that appears at the fot of the screen of turismoalcaladeguadaira.es.

Eight.- Modification and Cancellation of the Present Conditions

The Town Council reserves the right to modify total or partially turismoalcaladeguadaira.es, its design, contents and/or services, as well as the present Conditions whenever it was considered appropiated.

In the same way, the Town Council reserves the right to suspend, stop temporarily or cancel definitively turismoalcaladeguadaira.es or any one its contents and/or services, at their only and complete discretion.

Nine.- Applicable Law and Conflicts Resolution

The parts, waiving expressly their own jurisdictions, accept the Spanish legislation in force as the governing legislation for the present Conditions, and also for solving any controversies or lawsuits that may arise from them, they agree to submit themselves to the jurisdiction of the Courts of Seville.
